1. Acceptance of terms

By accessing or using the website evergreensports.inand any associated platforms or services (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please do not use our Services.

These Terms constitute a legally binding agreement between you and Evergreen Sports & Allied Solutions Private Limited(“Evergreen Sports”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013, with its registered office in Chennai, Tamil Nadu, India.

2. Description of services

Evergreen Sports provides:

• Information about our multi-sport academy, venues, coaching programmes, and sports gear.
• The Sports OS platform — a software-as-a-service product for managing sports venues, coaching academies, bookings, and player management.
• Online court and session booking facilities.
• Enquiry and contact facilities.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Eligibility

You must be at least 18 years of age to use our Services independently. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian. By using the Services, you represent and warrant that you meet this requirement.

4. User accounts

To access certain features of the Sports OS platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your login credentials.
• Notify us immediately at support@evergreensports.in if you suspect unauthorised access to your account.
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that we determine, in our sole discretion, have violated these Terms or applicable law.

5. Bookings and payments

• Court, coaching session, and event bookings are confirmed only upon successful payment, except where a deferred payment arrangement has been explicitly offered.
• Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Cancellation and refund terms vary by venue and booking type and are displayed at the time of booking. We are not obligated to offer refunds outside the stated cancellation window.
• We reserve the right to cancel bookings due to venue unavailability, force majeure, or safety concerns, in which case a full refund will be provided.
• Loyalty points earned through bookings have no cash value, are non-transferable, and may expire as described in the platform.

6. Sports OS — SaaS subscription terms

Organisations subscribing to the Sports OS platform agree to the following additional terms:

• Subscriptions are billed monthly or annually as selected at signup. Prices are subject to change with 30 days' advance written notice.
• Founding member pricing is locked in for 12 months from the date of subscription, after which standard pricing applies.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle. No pro-rata refunds are issued for partial periods.
• You are responsible for ensuring that your use of the platform complies with applicable law, including data protection obligations towards your own users.
• We reserve the right to suspend access immediately for non-payment or material breach of these Terms.

7. Acceptable use

You agree not to:

• Use the Services for any unlawful purpose or in violation of applicable Indian law.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorised access to any part of the Services or related systems.
• Introduce malicious software, scripts, or code into the Services.
• Scrape, crawl, or extract data from the Services without our prior written consent.
• Post or transmit content that is defamatory, obscene, hateful, or otherwise objectionable.
• Interfere with the proper functioning of the Services or disrupt other users' access.

8. Intellectual property

All content on this website and within the Sports OS platform — including but not limited to text, graphics, logos, icons, images, software, and data — is the property of Evergreen Sports & Allied Solutions Private Limited or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, transmit, or otherwise use any content from our Services for commercial purposes without our prior written consent. Personal, non-commercial use for the purpose of viewing and interacting with the Services is permitted.

9. Disclaimer of warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable Indian law, Evergreen Sports & Allied Solutions Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or related to the Services shall not exceed the total amounts paid by you to us in the 3 months preceding the event giving rise to the claim, or ₹5,000, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Evergreen Sports & Allied Solutions Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Third-party services

Our Services may integrate with or link to third-party services (such as payment gateways and mapping services). We are not responsible for the content, privacy practices, or reliability of any third-party services and encourage you to review their terms and policies independently.

13. Amendments

We may update these Terms at any time by posting a revised version on this page. Material changes will be communicated to registered users via email or an in-platform notice at least 14 days before they take effect. Continued use of the Services after the effective date constitutes your acceptance of the revised Terms.

14. Governing law & dispute resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
